A California businessman has been sentenced to 90 days house arrest after he pleaded no contest to the statutory rape of a child.

In addition to his 90 days of house arrest, Lyle Burgess, 79, also received five years of probation. Burgess will not have to register as a sex offender.

The girl was 5-years-old at the time of the rape, she is now 7-years-old. Her family's attorney, Meleyco told KTXL, "The girl is not doing good."

Meleyco added, "She's showing all the symptoms of somebody who's been molested. She's in counseling, and she's gonna be in counseling all her life."

While prosecutors did not comment on Burgess' sentencing, Meleyco said that Burgess' financial standing may have helped him, "He's obviously very wealthy and it's just an example of how the wealthy people, time and time again, escape the penalty for what they did."
