5-Year-Old Accuser Testifies in Delaware Co. Rape Trial

DELAWARE COUNTY (Ken Hines) -- A man accused of raping a five-year-old girl looked on as his young accuser testified in court Wednesday morning.

The girl drew pictures for jurors showing, what prosecutors say, was a sex act the girl was forced to perform on Delaware County corrections officer Randy Spencer.

Spencer is charged with seven counts of rape after allegedly forcing the girl to perform oral sex on him in April, 2013.

The alleged crime occurred when Spencer's girlfriend -- who had been hired to watch the victim and several other children -- left Spencer alone with the kids in order to visit a tanning salon.

Attendees who gathered in the courtroom Wednesday heard the young accuser crying in another room as she prepared to take the witness stand.

The presiding judge ordered the jury to leave the courtroom for a brief period of time while the girl's mother convinced her daughter to testify. The girl refused to speak Spencer's name in court, but did identify him to jurors.

The accuser's mother also testified Wednesday, telling the jury she removed her daughter from the care of Spencer's girlfriend after hearing the girl describe the alleged sexual assault.

The mother also testified that her daughter was visibly uncomfortable when in Spencer's presence. Defense attorneys countered that testimony by pointing out that the girl's mother had never before made that claim publicly.

Spencer showed little emotion as he listened to the girl's testimony, according to witnesses inside the courtroom.
