Prosecutor to Seek Suspension of Fairfield Co. Official Charged with Theft
COLUMBUS (Ken Hines) -- A special prosecutor will soon request the suspension of a Fairfield County official facing a theft charge, according to Ohio's auditor.
State Auditor Dave Yost told ABC 6/FOX 28 the prosecutor will ask the Ohio Supreme Court to suspend Fairfield County Clerk of Courts Deborah Smalley, who was arrested charged with theft in office in early October.
Smalley's husband, Dave, was also arrested in connection with the case, which involves claims from former employees that they were forced to work on the clerk's reelection campaign on county time.
"I don't want any retribution against any potential witnesses that might work in our office," Yost said. "If there's a provisional suspension -- that's what they call it in the law -- the officeholder's not [in] a position to take any adverse actions to hurt anyone."
Investigators decided to arrest the Smalleys amid fears they were planning to flee the area.
