Fairfield Co. Grand Jury Indicts Former Clerk of Courts

COLUMBUS (Ken Hines) -- A former Fairfield County Clerk of Courts has been indicted on 13 counts connected to financial improprieties that allegedly occurred while she was in office.

The indictments against Deborah Smalley include theft in office, tampering with records, and engaging in a pattern of corrupt activity. Smalley's husband, Dave, is also named in many of the indictments.

The Smalleys were arrested in early October, 2013 after an investigation by the Ohio Auditor's Office turned up evidence of financial misconduct.

The investigation concerned allegations that arose in mid-June, when former employees complained that they were required to make campaign contributions and work on Smalley's reelection effort while on county time.

After the allegations came to light, security cameras caught Dave Smalley using his wife's key card to enter the clerk's office after-hours on June 30, bringing in and removing items to and from the building.

No elected official is above the law but neither is any elected official beneath it, Ohio Auditor Dave Yost said.  This indictment brings Ms. Smalley to the bar of justice, where she will get her day in court."

Smalley resigned her position as Fairfield County Auditor in December, 2013.
